1. What the service is

El DeCA is a tool that generates electronic administrative control documents from the data the user enters, hosts them at a directly downloadable web address, and keeps them for the period stated in these terms.

The service generates the document with the technical characteristics required by the applicable regulation. The accuracy and truthfulness of the data entered is the user's sole responsibility, as is the decision of whether a specific transport requires a control document. The provider does not verify the data and cannot do so.

2. Account and use

• The user is responsible for the confidentiality of their credentials and for the activity carried out from their account.
• Driver PIN codes grant access to issue documents on the account's behalf; it's up to the account holder to manage and revoke them.
• The service may not be used to generate documentation for transports that won't actually take place, or with data known to be false.
• Signing up doesn't require verifying the email to use the account, but it's still requested to confirm the address belongs to the holder.

3. Plans, limits and overage

On reaching the plan's monthly limit, issuing is not interrupted. Additional documents are billed at the stated overage price, together with the following period's fee. Los precios no incluyen IVA. El impuesto que corresponda se calcula al finalizar la compra.

4. Document retention

Issued documents are kept and remain accessible for at least one year from the date of the transport they document, so the user can meet their retention obligation.

That retention obligation falls on the user, not the provider. The service makes it easier to meet, but the user must be able to have their documents by their own means: it's recommended to periodically download the history.

Downloading documents is available on every plan, with no limit and at any time, one at a time, from the account and from each document's verification web address. Downloading the full history as a single compressed file, with its index, is included from the Sole Trader plan onward.

5. Cancellation and archive mode

The subscription can be cancelled at any time and takes effect at the end of the paid period. There is no minimum term.

After cancellation, the account moves to archive mode: it can no longer issue new documents, but the user keeps read and download access to the ones already issued until each one's retention period ends. If the plan included exporting the full history, that's kept too in archive mode, so all documents can be taken after cancelling.

6. Availability and liability

The provider will use reasonable means to keep the service available, but does not guarantee uninterrupted or error-free operation. Interruptions may occur due to maintenance or causes beyond its control.

The provider is not liable for fines, claims or losses arising from incorrect data entered by the user, from failing to issue a required document, from the document not being carried on board the vehicle, or from the Administration's assessment in a specific case.

Nothing in these terms excludes liability that cannot legally be excluded, nor the rights that apply to the user when they have consumer status.

7. Changes to the terms

The provider may amend these terms, giving reasonable advance notice by email or from within the application itself. If the user disagrees, they may cancel the subscription before the change takes effect.
